These Terms & Conditions (“Agreement”) govern your access to and use of our website [shivagraphics.odoo.com], as well as the purchase, download, and use of digital design products available through Shiva Design Store (“we,” “us,” or “our”).

By accessing or using our website, or by purchasing any of our products, you acknowledge that you have read, understood, and agree to be bound by this Agreement.

If you do not agree with these Terms, please refrain from using our website or services.

1. Definitions

• Products: digital design files (e.g., .cdr, .pdf, .jpg), templates, and related assets sold on the Site.

• Buyer / You / Customer: person or entity purchasing Products.

• Personal License: limited license for private, non-commercial use.

• Commercial License: paid license allowing business or client use as described in product listing.

2. Acceptance & Eligibility

By making a purchase you confirm that you are at least 18 years old and authorized to enter into this Agreement. If you do not agree, do not use the Site or purchase Products.

3. Orders & Payment

• All prices are shown on the product page and include applicable taxes where required.

• Payment methods: Razorpay, PayPal, Stripe (as configured). Payment is processed by third-party payment gateways — we do not store full card details.

• Order confirmation is sent by email after successful payment.

4. Digital Delivery & Download Rules

• After successful payment, Buyers receive a secure download link delivered via email and/or on the order confirmation page.

• Download link(s) expire after 48 hours and/or 3 downloads (or as specified per product).

• It is the Buyer’s responsibility to download and securely store purchased files. We may extend access in exceptional cases; contact support.

5. License, Use & Restrictions

• Each Product is sold with the license option selected at checkout (Personal or Commercial). The license terms displayed on the product page and included in license.txt inside the ZIP file apply.

• Personal License: You may use the file for personal, non-commercial printing and use. You may edit the file for personal use. Resale, distribution, sublicensing, or sharing the original source file is prohibited.

• Commercial License: Allows use of the design for client or business projects as described on the product page. Resale of the original source file or redistribution is prohibited unless expressly permitted.

• You may not claim ownership of the original design or distribute it as your own.

• Any use beyond the licensed rights requires written permission and possibly an additional license fee.

6. Customization Services

• If you order customization, timelines, deliverables, and additional fees will be agreed before starting work. Custom work may have different refund/cancellation terms.

7. Refunds & Cancellations

• Digital Goods: Due to the nature of digital downloads, refunds are generally not provided once the file has been downloaded.

• If files are corrupt, incorrect, or materially different from the product description, contact us within 7 days of download with order ID and evidence; we will review and may offer a replacement, repair, or refund at our discretion.

• For unauthorized repeat downloads or technical delivery failures, we will attempt to resolve and can reissue download links.

• Cancellations before download/payment are subject to cancellation confirmation and possible processing fees.

8. Intellectual Property (IP)

• All Products, previews, and site content are protected by copyright and other IP laws.

• We retain ownership of original designs unless otherwise agreed in writing. Buyers receive only the license rights described above.

• If you believe any content on our Site infringes your IP rights, contact us with a detailed takedown notice.

9. Refund Fraud & Abuse

• Attempts to abuse refund policy, chargebacks without contacting support, or redistribution of files may result in account termination and legal action. We reserve the right to pursue damages.

10. Account & Security

• Registering an account may be required to manage downloads. You are responsible for maintaining the confidentiality of account credentials and for all activity on your account. Notify us immediately of unauthorized use.

11. Warranties & Disclaimers

• Products are provided “as is.” We do not guarantee compatibility with every software version or third-party system. Buyers should verify compatibility with CorelDRAW versions before purchase.

• To the maximum extent permitted by law, we disclaim all warranties — express or implied — about merchantability, fitness for a particular purpose, or non-infringement.

12. Limitation of Liability

• Our maximum aggregate liability to you for any loss arising from or related to purchases is limited to the amount actually paid by you for the specific Product. We will not be liable for indirect, incidental, or consequential damages.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities, costs (including legal fees) arising out of your use of Products in violation of this Agreement.

14. Privacy & Data

• We collect and process personal data as described in our Privacy Policy. By using the Site you agree to our data practices. Payment processors may collect additional data per their terms.

• If you require deletion of your personal data, contact us and we will act per applicable law (subject to legal obligations).

15. Governing Law & Dispute Resolution

• These Terms are governed by the laws of [uttarpradesh/India]. Any disputes will be subject to the exclusive jurisdiction of courts located in [tundla, up].

16. Changes to Terms

• We may modify these Terms from time to time. Changes will be effective when posted with a new “Last updated” date. Continued use after changes constitutes acceptance.
